January 2, 2018: All appeals have been dismissed and the Settlement has become final and effective.

Tier 1 payments will be mailed on January 12, 2018. We anticipate that Tier 2 payments will be mailed on or before March 9, 2018.

September 27, 2017: On August 22, 2017, the Court entered an Order Granting Final Approval and Entering Final Judgment to the Settlement. Appeals were filed on September 14, 2017, September 19, 2017, and September 22, 2017.

No payments can be made until after the appeals are concluded. The appeals process is likely to take at least several months.

August 21, 2017: On August 21, 2017, an Order granting Final Approval and entering Final Judgment was completed by Judge Otis D. Wright, II, in favor of Plaintiffs against Guthy-Renker LLC, Wen By Chaz Dean Inc.

At this time, the parties are awaiting the Final Judgment from the Court. Payments to eligible Class Members who submitted valid and timely Tier 1 Claims will be distributed only after the Final Judgment is entered by the Court. Payments to eligible Class Members who submitted valid and timely Tier 2 Claims will be distributed only after the Final Judgment is entered by the Court and the Special Master completes her evaluation of all Tier 2 Claims.

July 20, 2017: The Court held a hearing on June 5, 2017. After the hearing the Court requested supplemental information from the parties, which was filed on July 3, 2017. On July 5, 2017, the Court indicated that it will issue a final order based on the documents submitted. At this time, the parties are awaiting that final ruling from the Court. Payments to eligible Class Members who submitted valid and timely Claims will be distributed only after a final settlement approval order is entered by the Court, the Special Master completes her evaluation of all Tier 2 Claims, and after any appeals of that order are resolved, if there are any.
